These Terms of Use ("Terms") constitute a legally binding agreement between you and the Pitchly developer ("we", "us", or "our"). These Terms govern your use of the Pitchly mobile application ("the App") available on Apple's App Store.
If you are using the App on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
Pitchly is an ear-training application designed to help musicians and music learners develop pitch recognition skills through structured, gamified quizzes. The App provides:

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on Apple devices that you own or control, solely for your personal, non-commercial purposes.

"Pitchly" and the Pitchly logo are trademarks of the developer. You may not use these marks without our prior written permission.
Your practice data (scores, streaks, preferences) remains your own. We claim no ownership of the data you generate through normal use of the App.
We do not warrant that the App will be error-free, uninterrupted, or free of viruses or other harmful components. We make no warranty that:
Pitchly is an educational tool intended to supplement — not replace — formal music training. Results vary based on individual practice consistency and aptitude.
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:
Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid for the App in the twelve months preceding the claim (which for a free app is zero).
Some jurisdictions do not allow the exclusion or limitation of liability for consequential damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.
You acknowledge that these Terms are between you and the Pitchly developer only, and not with Apple Inc. Apple is not responsible for the App or its content.
Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if applicable) to you. Apple has no other warranty obligation.
Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability, legal compliance, or consumer protection claims. Apple is a third-party beneficiary of these Terms and may enforce them against you.
These Terms remain in effect until terminated. Your rights under these Terms will terminate automatically if you fail to comply with any of their provisions.
You may terminate these Terms at any time by deleting the App from your device. Upon termination, all licences granted to you cease immediately.
We may also suspend or terminate your access to the App at our discretion, with or without cause, and with or without notice.
These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through good-faith negotiation wherever possible.
If you have a concern or dispute, please contact us first and we will make every effort to resolve it amicably.
We reserve the right to modify these Terms at any time. When we do, we will update the "Last updated" date at the top of this page.
For material changes, we will provide notice through the App or App Store release notes. Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
We encourage you to review these Terms periodically. If you do not agree with the updated Terms, you should stop using the App.
